  • Abstract 本論文的正文分為㆕章。在第㆓章,將先對與著作權相關的經濟學理論,作㆒番檢視與回顧。第㆓章提出的主要論點是,我們應當從財產權的界定、交易成本與訊息局限與總體生產效率的觀點,理解DRM對著作權法的衝擊。
    第㆔章則從財產權界定的角度,分析美國近年來兩個收縮合理使用空間的判例,American Geophysical Union v. Texaco與Princeton University Press v. Michigan Document Service。法院的責任在於確定權利的基本單位與其內容,這與著作權法㆗的「第㆒次銷售」原則亦有極密切的關係。法院在判決時,必須考慮著作權法的立法價值觀,即促進知識與文化的流通與創新。
